Contractual Partners: These General Terms and Conditions (hereinafter "GTC") regulate the contractual relationship between Worqhome UG (haftungsbeschränkt) (hereinafter "Worqhome") and the natural or legal persons who offer accommodation via the platform (hereinafter "Provider" or "Customer").
Target Group: The offer is directed at entrepreneurs (14 BGB) and commercial landlords.
If the provider acts as a consumer, the statutory provisions apply complementarily.
Exclusivity: These GTC apply exclusively. Deviating conditions of the provider are not recognized.
Registration: Use requires complete registration. All information (esp. identity, address, VAT ID no.) must be truthful.
Conclusion of Contract: The contract is concluded as soon as the provider selects a service package (e.g., BASIC, PLUS, PRO, MAX) and completes the ordering process (click on "Order with obligation to pay") and Worqhome activates the account.
1. Package Structure: Worqhome offers various service packages (BASIC, PLUS, PRO, MAX).
The specific scope of functions (e.g., number of photos, contact options, links) result from the service description valid at the time of concluding the contract on the platform.
2. Ranking Logic (Sorting):
To provide relevant search results, listings are ranked using a cascading system based on geographical distance and package priority:
a) Distance Zones (Radius Circle): Search results are divided into radius zones: Zone 1 (up to 5 km), Zone 2 (up to 10 km), Zone 3 (up to 20 km), and Zone 4 (up to 40 km). Listings in a closer zone are generally listed before listings in a more distant zone.
b) Package Priority within the Zones: When crossing each zone boundary, sorting within the new zone starts anew. Within each zone, listings are ranked according to their package category in the following order: MAX > PRO > PLUS > BASIC.
c) Package-dependent Reach: The maximum visibility of a listing is limited to the radius of the chosen package. Listings in the BASIC package are only visible up to 5 km, PLUS up to 10 km, PRO up to 20 km, and MAX up to 40 km. Outside these radii, the listing is not displayed in the search results.
d) Secondary Criteria: Within the same zone and same package category, sorting is based on distance to the input location.
3. Overview of Functions (Excerpt):
1. Prices: The prices according to the current price list on the website at the time of the conclusion of the contract apply. All prices are for entrepreneurs plus the statutory VAT. Sales actions or discounts only apply for the specified period.

3. Billing Period: The provider can choose between monthly and annual payment methods (if offered in the ordering process). For annual payment, the total amount is due in advance.
4. Payment Methods: The payment methods displayed in the checkout process (e.g., credit card, PayPal, bank transfer) are accepted.
5. Default and Reactivation: If the provider is in default, Worqhome is entitled to temporarily deactivate the listings. For the reactivation of an account blocked due to payment default, Worqhome may charge a processing fee of 15.00 EUR (net).
6. Returned Debits: For failed direct debits or credit card charges for which the provider is responsible, Worqhome charges a processing fee of 10.00 EUR (or equivalent in local currency) plus the actual bank fees incurred.
1. Contract Models: The provider can choose between a monthly subscription (with automatic collection) and an annual package (manual payment by the customer).

3. Form of Termination: To ensure fast and automated processing, termination takes place exclusively via the termination button in the user dashboard ("End Subscription"). Termination by email or post is excluded, provided that access to the dashboard is technically possible.
4. Upgrades: A change to a higher service package (upgrade) is possible at any time. The upgrade is activated immediately after completion of the ordering process and successful payment. Offsetting against payments already made is pro-rata.
5. Downgrades: A change to a lower service package (downgrade) is possible at any time with effect for the next billing period. Until the end of the already paid period (month or year), the provider retains the full scope of functions and the visibility of the higher package. A (pro-rata) refund of fees for the current period does not take place in the case of a downgrade.
Content: The provider guarantees that they have all rights to the uploaded photos and texts.
Laws: The provider is solely responsible for compliance with local regulations (misappropriation, commercial law, imprint obligation).
Backlink: If the package (PRO/MAX) allows a link to the own homepage, the provider guarantees that the linked page is free of illegal content.
The provider grants Worqhome the right to display the content provided (photos, texts) on the platform.
For the "PRO" and "MAX" packages, the provider expressly agrees that Worqhome may also use this content for promotion on social media channels (e.g., "Listing of the Week").
Indemnification: The provider indemnifies Worqhome from claims of third parties based on illegal use of the platform or illegal content of the provider.
Worqhome Liability: Worqhome is liable without limitation in cases of intent and gross negligence. In cases of slight negligence, Worqhome is only liable for the breach of essential contractual obligations, limited to foreseeable damage.
No Guarantee of Success: Worqhome owes the technical provision of the listing, but not a certain rental success or a certain number of inquiries.
Changes: Worqhome reserves the right to change these GTC. Changes will be announced at least 15 days before becoming effective.
Law: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Place of Jurisdiction: Place of performance and place of jurisdiction is the registered office of Worqhome.
Worqhome UG (haftungsbeschränkt), Brinkstr. 19, 49685 Emstek (hereinafter "Worqhome"), operates an online portal for the mediation of accommodations. These terms apply to every visitor to the website.
Platform: Worqhome provides a technical infrastructure that enables providers to publish listings and searchers to view them.
Role of Worqhome: Worqhome is a technical intermediary. Rental agreements are concluded directly between the provider and the searcher. Worqhome is not a party to the rental agreements.
Listing Ranking: Users are advised that the order of the displayed search results is influenced by the service packages (Basic to Max) booked by the providers. Paid premium listings are displayed with priority.

A list of these certified bodies is published by the European Commission.
